Matt is an attorney and shareholder with the law firm Cohne Kinghorn, P.C. His practice concentrates in the areas of bankruptcy/insolvency, real estate, business/commercial litigation and creditors’ rights.

Bankruptcy & Rehabilitation.  Matt is experienced in all aspects of bankruptcy, receivership and insolvency law.  He has successfully represented many chapter 11 debtors and has assisted them in achieving their goals for restructuring, discharge and orderly sales of assets.  He has assisted his clients to confirm chapter 11 plans, obtain court approval of “free and clear” asset sales, obtain bankruptcy discharges and implement other bankruptcy strategies.  He has successfully protected the rights of secured creditors and unsecured creditors in bankruptcy, receivership and other legal proceedings.  Finally, Matt regularly represents bankruptcy trustees, committees and receivers.

Trial and Litigation.  Matt is an experienced trial lawyer and a zealous advocate.  He has represented clients involved in litigation and/or arbitration in many different types of disputes.  Matt has represented clients in the following types of matters, among others:

  • real estate disputes;
  • quiet title actions;
  • contract disputes;
  • lien and lien priority disputes;
  • loan recovery and lien foreclosure matters;
  • corporate and partnership control disputes;
  • securities fraud;
  • business torts, including wrongful interference with economic relations;
  • probate, will contests and inheritance disputes;
  • malpractice/professional negligence;
  • lender liability litigation;
  • disputes involving sales governed by the Uniform Commercial Code;
  • disputes under Articles 3 and 4 of the Uniform Commercial Code;
  • disputes involving secured transactions governed by Articles 9 of the Uniform Commercial Code;
  • patent infringement; and
  • trademark infringement and other claims under the Lanham Act.

Bank Representation and Creditors’ Rights.  Matt has extensive experience in all areas of creditors’ rights and debtor-creditor relations, including loan documentation, workouts and debt restructurings, collection litigation, foreclosures, receiverships, bankruptcy and lender liability litigation.

Real Estate.  Matt represents buyers, sellers, landlords, tenants, real estate professionals, loan brokers, investors, builders, developers and others involved in real estate transactions and the real estate industry.  Among other things, he has assisted buyers, sellers, landlords and tenants complete purchase and lease transactions. He also has assisted real estate brokers and agents to defend malpractice claims, to resolve investigations by the Division of Real Estate, in commission disputes and many other real estate matters.
