Creditors’ Rights
The Creditors’ Rights practice group regularly advises and represents local, regional and national lenders, commercial and trade creditors, contract parties, and various other secured and unsecured creditors in collecting their debts, enforcing their contract rights, and obtaining the relief to which they are entitled under applicable laws. Our lawyers have extensive experience and expertise in collecting debts through pre-litigation efforts, negotiating and litigating when necessary to obtain a judgment or favorable settlement, foreclosing on collateral (real and/or personal property), enforcing settlement agreements and collecting on judgments, and aggressively asserting creditors’ rights in bankruptcy cases.
Because our creditors’ rights lawyers also have broad experience representing debtors, trustees and receivers in bankruptcy and receivership cases, they understand how the other side thinks and they strive to quickly resolve matters in favor of their creditor clients without unnecessary delay and expense. For instance, in bankruptcy cases, we regularly assist our creditor clients in obtaining relief from the automatic stay, in preserving creditor claims and contract rights, and in defending against preferential transfer, fraudulent transfer, and other bankruptcy “avoidance” actions brought by a debtor or trustee.
